Andrew Serrano, who was East Rochester’s Deputy Mayor at the time, is on trial facing charges of Endangering the Welfare of a Child and Reckless Endangerment in the 2ndDegree for an incident at an East Rochester Youth Soccer League game back in June. Monroe County Sheriff’s Office Investigators claim Serrano threw his 5-year-old son into a folding chair and forciblythrew water in his face while yelling at him.

In a statement to police the soccer team’s coach said he saw Serrano “toss (his son) into a pop-up chair” from about three or four feet awayand that the boy’s “feet did not touch the ground.”

“Three or four feet maximum,” Serrano’s lawyer Frank Odorisi reiterated in an interview after the courtappearance.  “Mr. Serrano didn’t pick the child up and throw him into the seat, he swung the child around and put him in the chair and the chair tipped over and this chair could tip overwith your pinky. … The statutes require substantial physical injury. The pouring of the water could not cause substantial physical injury.”

The judge denied a motion to dismiss thecharges against Serrano.
